Silva Asks For New Trial In Derby Homicide

COURTESY MARA LAVITTA/NEW HAVEN REGISTERAn Ansonia man serving a 50-year prison sentence for murdering a distant cousin outside a Derby bar is asking the state’s Supreme Court for a new trial.

A jury at Superior Court in Milford found Cordaryl Silva, 28, guilty of murder after a five-day trial last spring.

Silva was convicted of killing Javon Zimmerman, a chief lieutenant in a Valley-wide drug dealing organization headed by Javon’s brother, Keyshon Zimmerman.

But in a 72-page appeal brief prepared by Glenn Falk, a lawyer at the New Haven Legal Assistance Association, Silva asks for his murder conviction to be set aside and a new trial ordered.

The lawyer argues the judge at the trial should have allow Silva to represent himself and should have barred a detective from answering certain questions about an interview with Silva.

Silva Gets 50 Years For Derby Murder

courtesy mara lavitta/new haven registerFacing more than 60 years in prison for killing a distant cousin outside a Derby bar two years ago, Cordaryl Silva maintained his innocence Tuesday at his sentencing in the case.

Despite that, Silva called his murder conviction a blessing in disguise” while presenting an unconventional request to Judge Denise Markle.

Give me 63 years, the maximum,” Silva said. I feel God’s going to overturn this case for me in time.”

Jury Finds Ansonia Man Guilty In 2012 Killing

From trying to fire his lawyer moments before the first witness was called to confronting an eyewitness en route to the stand to interrupting the prosecutor’s closing argument, Silva was not shy about showing his feelings.

That had changed by about 4:15 p.m. Tuesday, when six men and six women took fewer than three hours to find him guilty of shooting 22-year-old Javon Zimmerman outside RJ’s bar in Derby May 12, 2012.

Silva stood motionless next to his lawyer after the verdict, remaining so until the jury left and he was taken by marshals into the courthouse lockup.

Silva: I Didn’t Do it, ‘My Boy’ Did

He hurried through the packed bar and ordered two beers along with three gin and juices.

He downed one of the cocktails and passed out drinks to friends.

He walked toward the entrance and saw a car drive into the parking lot.

Inside the vehicle was Javon Zimmerman, who within minutes would lie dead on the pavement outside.

Silva, the man on trial for his murder, told the jury weighing evidence in the case Friday that he didn’t do it — but he refused to name the person who he said actually pulled the trigger.

Lawyer: Silva Plans To Testify

Just before 2 a.m. May 12, 2012, Quandre Howell held Javon Zimmerman in his arms on the pavement outside a Derby bar.

Moments earlier, Zimmerman had been shot twice. He had less than a minute to live.

With his last breaths he repeated Beans,” Howell’s nickname, over and over again.

When Derby police were looking for information and witnesses, they grilled Howell while he was wearing a shirt with Zimmerman’s picture on it, mourning his friend’s demise. At times during the interview, he seemed on the verge of tears.

Yet he still wouldn’t ID the shooter.

‘I Have A Dead Guy In Derby And Everybody’s Telling Me You Did It’

About 12 hours after being called to investigate the killing of an Ansonia drug investigation’s chief target outside a Derby bar, Detective Sgt. John Netto sat across from the sole suspect in the shooting and tried, again and again, to level with him.

If I could draw a target, it’s on you. Tag, you’re it. Your life changed last night, and I can’t say it’s for the better,” Netto told Cordaryl Silva, then 24.

Silva reclined in his chair across a small table from the police supervisor in an interview room at the Ansonia police station.

I have a dead guy in Derby and everybody’s telling me you did it,” Netto said.

Conflicts Mark First Day Of Derby Murder Trial

FILEThe trial of Cordaryl Silva, the 26-year-old Ansonia man accused of shooting and killing a distant cousin outside a Derby bar in May 2012, began with acrimony Tuesday and ended in similar fashion. 

Minutes before testimony in the case was scheduled to begin at Superior Court in Milford, Silva made a surprise plea to fire his lawyer, but was rebuffed by Judge Denise Markle. 

And just before court adjourned for the day, it was prosecutor Charles Stango’s turn to be angry — with a witness to the shooting who had told police Silva was the shooter, only to recant the statement after taking the stand.
