DERBY – The city’s legislative body voted unanimously March 13 to settle a federal lawsuit brought by a woman who said a police officer used excessive force while arresting her in 2017.
The terms of the settlement, such as how much money the plaintiff is getting, if any, were not available March 13.
Derby Corporation Counsel Richard Buturla said he will have a settlement document within 10 days (March 27) with information for the public. The federal court database shows the case settled as of Feb. 7, pending approvals from the towns involved.

DERBY — A tax board meeting scheduled for Tuesday (March 25) has been canceled, according to the City of Derby’s website.
Mayor Joseph DiMartino had been scheduled to present a budget to the members of the tax board for review.
However, the meeting was canceled due to the death of a loved one inside Derby Finance Director Brian Hall’s family, according to a cancellation notice.
There’s no word yet on when the meeting will be rescheduled.
The next regularly-scheduled meeting of the tax board is slated for April 1.

Jaelynn Dwyer attended the 'The Pocono Indie Project,' a festival that screened a short film she's in.
DERBY – Derby Middle School student Jaelynn Dwyer was in Pennsylvania in February to attend the premiere of “Angelica,” an independently-produced short film she acted in.
She stars as the title character!
The Valley Indy conducted the following Q&A with Jaelynn over email.
Valley Indy: What’s your age and grade?
Jaelynn: “I’m 13 and in eighth grade at Derby Middle School.”
Valley Indy: The short film is called “Angelica” What’s it about?
Jaelynn: “It’s about a group of teenagers who mess with paranormal stuff when they probably shouldn’t.”

DERBY – The chairman of the Derby Republican Town Committee said the Democratic mayor isn’t following the rules when it comes to replacing Republican members on the city’s planning and zoning commission.
Gino DiGiovanni Jr., the GOP chairman and the chairman of the planning and zoning commission, made his remarks during the March 13 meeting of the Derby Board of Aldermen and Alderwomen.
His statements were refuted by the Derby corporation counsel, who said appointments to the commission are spelled out in a specific Derby ordinance, and that the administration is following that ordinance.

DERBY – A developer who wants to build a 45-lot subdivision atop “Telescope Mountain” in west Derby temporarily pulled his application from the Derby Planning and Zoning Commission.
Dominick Thomas, the lawyer for the developer, Summit Hill LLC, wrote a letter dated March 14 to Gino DiGiovanni, Jr. saying the withdrawal is needed, because the developer must first go to the Derby Inland Wetlands Commission.
Members of the Inland Wetlands Commission are tasked with making sure new development doesn’t damage existing wetland or water courses.

DERBY – Derby Public Schools Superintendent Matthew Conway said March 18 that the school district should be able to cover a $594,669 spending increase in its proposed budget for the next school year.
“Over the past couple of months, things have gone up and down, but I think we are in a great place and have a plan for funding this budget moving forward that will hopefully not require any increase in our mill rate,” Conway said.
Conway made his statement during a budget meeting of the Derby Board of Apportionment and Taxation, also known as the tax board. Its elected members approve an annual budget.
The Derby Board of Education adopted a budget of $21,043,120 with a 2.91 percent spending increase in February, and then sent it to the tax board to review.

DERBY – A judge ruled March 10 that a lawsuit filed by a man stabbed on Derby school grounds cannot go forward because the city’s government and school district are protected by governmental immunity.
Melvin Mujica-Cruz was attacked and stabbed by two assailants after a Derby versus Emmett O’Brien basketball game at Derby High School on Feb. 14, 2022. Mujica-Cruz is an adult who was at the campus to watch his teen relative play for Derby.
