A man accused of terrorizing two teens during a drunken home invasion last year in scheduled to appear in Superior Court in Milford May 24.
David Messer, 31, of Derby, is charged with first-degree burglary, third-degree assault, second-degree unlawful restraint, criminal mischief, first-degree criminal trespass and two counts of risk of injury to a minor.
The charges stem from an incident Dec. 7, 2010 when Messer allegedly started banging on a door of a residence on Hawkins Street at about 7:30 p.m.
Two teens — a 13-year-old girl and her 15-year-old brother — were the only people inside.
The girl, not knowing who was banging on the door, was frightened and laid down onto the floor. Messer than allegedly kicked the door open, sending paint and wood chips flying, according to a police report.
The 15-year-old brother confronted him, asking him who he was.
“You don’t need to know who I am,” Messer allegedly said before punching the boy in the face.
The girl then called 911, according to the police report. Messer asked who she was calling. She told him she was calling her father.
He sat down next to her and put is arms on her to restrain her, police said.
Derby police arrived and saw Messer with his arm around her shoulders. They took him to the ground and put him in handcuffs.
“While trying to speak to Dave, it was clear that he was under the influence of drugs and or alcohol,” according to the police report.
Officers noted that his speech sounded slurred, he was incoherent and smelled of alcohol.
The 15-year-old brother was treated by EMS at the scene.
Messer allegedly said he was trying to find someone named “John.”
Messer’s criminal history includes convictions for resisting arrest, operating a motor vehicle with a suspended license, criminal trespass and fourth-degree larceny.
He’s on probation and free on a $50,000 bond. He has yet to enter a plea to the criminal charges.
Glenn Conway, Messer’s lawyer, was not available to comment Monday.
