Derby ZBA To Consider Multi-Family Proposal Tonight

The city’s zoning board of appeals is scheduled to meet tonight to consider a proposal to covert two, two-family apartment houses on Sodom Lane to three-family units.

The meeting is scheduled to start at 6:30 p.m. at Derby City Hall — and the public is allowed to speak on the application.

The properties in question are at 85 and 87 Sodom Lane. Click here for a map.

They are owned by Jalowiec Realty Associates, LP.

Jalowiec wants to add a garden apartment in the basement of each property.

The properties were built in 1998, and fell into the city’s R-5 zone, which allowed multi-family dwellings through a special exception, according to minutes from previous Zoning Board minutes.

However, the city changed the rules in 2000, prohibiting multi-family dwellings there.

A 2008 zoning map on the Electronic Valley shows the properties as falling within the city’s R-2 zone.

However, Jalowiec is arguing that his apartment houses were initially built with three apartments in mind — there are already three gas and electrical meters in place, for example.

Jalowiec needs two variances regarding the basement apartments — but he also needs four other variances involving parking at the apartment houses.
