Ansonia has settled a lawsuit with a Shelton-based developer over a four-acre parcel off of Hoinski Way.
White Hills Homes, LLC had initially planned to build four homes near the Woodbridge line.
The Planing & Zoning Commission struck it down, however.
The Planning and Zoning Commission was concerned about building on a former rubber dump at the site, and said the city had previously determined the land could not be developed.
So in January 2010, the developer sued Ansonia for potential lost profit.
Stephen Bellis, an attorney for White Hills Homes, LLC, said the city and the developer settled the suit in May 2011. Bellis withdrew the lawsuit as part of the settlement.
The settlement restricts White Hills Homes to two lots instead of four, on the condition that they not develop the back half of the property in any way — including with lawns, billboards, or by allowing “destructive or offensive recreational vehicles.”
The land will remain privately owned by White Hills Homes, LLC under the settlement.
White Hills Homes, LLC is also restricted from further subdividing the two lots.
Bellis said the settlement is a good deal because White Hills Homes, LLC can still develop two of the four proposed homes on the land.
The development will hook into the existing water and sewer lines on Hoinski way.
Bellis said that the two houses will be approximately 2,000 square feet each. The developer has not yet applied for building permits.
Corporation Counsel Kevin Blake declined comment on the settlement, referring comments to the city’s Planning and Zoning Commission.
Bart Flaherty, the chairman of the Planning & Zoning Commission, was unable to be reached Tuesday for comment.
