The attorney for a development company looking to build a medical complex off Route 67 said his client will re-apply for a zone change that was recently tossed out of court.
Dominick Thomas represents Salton Enterprises, who submitted an application to the Oxford Planning and Zoning Commission requesting that a residential area near Wedge Hill Road be rezoned from residential to commercial.
Neighbors opposed the application, saying it would allow a commercial district to encroach on their residential neighborhood.
The town’s Planning and Zoning Commission approved the zone change on Jan. 21, 2010.
On Oct. 5, a judge granted Wall’s motion for a judgment on the case. The town’s Planning and Zoning Commission erred by not giving the required 10 days advance legal notice on a public hearing on the zone change, the judge pointed out. The town had given nine days notice.
Thomas said the judge’s decision was based on a legal technicality — the judge did not rule on the merits of the zone change, he said.
“It’s a technicality. We’re going to re-apply. We’re going to go back again,” Thomas said.
Thomas said he could not be certain when Salton Enterprises will submit another zone change application to Oxford Town Hall.
Salton Enterprises has conceptual plans to build a four-building office complex on land stretching from Route 67 up toward Wedge Hill Drive.
