Peter Botti Will Be Sentenced Wednesday

Peter Botti, the father of Shelton developer James Botti, will be sentenced in federal court on Wednesday for his admitted role in helping his son structure cash deposits. 

Peter Botti pleaded guilty to structuring in June 2009 after a federal investigation.

Structuring is when cash payments or deposits are broken up into less than $10,000 segments to avoid detection by the IRS.

Federal prosecutors said Peter Botti helped his son, James Botti, structure almost $100,000 in cash deposits through the father’s bank accounts. The younger Botti was being investigated by federal agents for structuring and other corruption charges. James Botti is currently in prison after being convicted by two separate juries.

Peter Botti, who is 83 years old, has asked the court to consider giving him a sentence the consists of only probation. In a memo to the U.S. District Court (posted below), Peter Botti’s attorney asks the judge to take into consideration Peter Botti’s time serving the U.S. Army, his previous clean record and his long productive and law-abiding life.”

Peter Botti faces up to five years in prison for the charge, but sentencing guidelines suggest he could receive anywhere from 10 to 16 months, plus a $3,000 to $30,000 fine, according to a memo from Senior Litigation Counsel, Richard Schechter (posted below).

Schechter said the government doesn’t specifically request jail time, but does request that Peter Botti pay a fine. 

The sentencing will take place at 10:30 a.m. at U.S. District Court in New Haven.
