Lawyer: Show Me The Evidence

The lawyer for Daycus Bailey, one of three men accused in an ambush-style shooting on Chapel Street in August, wants police and prosecutors to hand over forensic evidence in the case.

Gary Mastronardi filed a motion Dec. 8 to compel discovery in Superior Court in Milford.

Mastronardi wants to see the evidence prosecutors will use against his client, who is being held on $1 million bond on charges of first-degree assault with a firearm and conspiracy to commit first-degree assault.

Police said Bailey, Stephen Cook and Robert Smith rammed their car into a SUV being driven by Keirron Stanley, who had just left his job at a Chapel Street business, and then opened fire on Stanley.

Bailey and Cook are due in court Jan. 12. Smith is due in court Jan. 11.

Bailey’s case file contains no information from police or prosecutors.

In his motion to compel discovery, Mastronardi writes: 

The materials requested by the defense — particularly the results of certain forensic examinations conducted by police — are critical to the defendant’s in that the results of such tests, it is believed, would be highly exculpatory and thus extremely favorable to the defendant.”

Mastronardi also wants to see any evidence police have against Bailey, including photos, documents and a list of witnesses.
