Derby Man Shot By Police Due Back In Court In April

ANSONIA-DERBYA Derby man accused of shooting at a stranger’s car is due back in Milford court in April.

Corneilus McCullough has three felonies and two misdemeanor charges pending in connection to an incident on the Ansonia-Derby border on April 26, 2021, which culminated in an on-duty officer shooting McCullough in the leg.

On that morning, McCullough, along with his cousin, approached Officer Patrick Foley’s police cruiser just after 7 a.m., according to a report by the Office of Inspector General. McCullough told Foley he was being chased and asked for assistance.

A black Infiniti sedan then drove slowly past the scene. McCullough allegedly walked toward the car and fired several shots in its direction.

Two of McCullough’s shots hit the sedan, according to the report, whose driver was a hospital worker coming home from a night shift. The driver, who did not know McCullough, was uninjured. 

Foley shot McCullough three times in his right leg. The shooting was justified, according to the inspector general’s report.

While in the hospital, McCullough behaved erratically in conversations with officers. He stated people outside his room were talking about him when in fact no one was there, the report says. 

McCullough’s gun was recovered from the scene. Fentanyl was found in his house by police while serving a search warrant. A toxicology report had been ordered for him in the hospital but was never performed.

McCullough has been in custody since the incident. He charges including attempted assault, reckless endangerment, and illegal discharge of a firearm. He is currently being held at MacDougall-Walker Correctional Institution.

McCullough was scheduled to appear in court on Thursday (Feb. 29). However, his appearance was continued, which means he’s not due to appear again until Tuesday, April 9.
